1. Acceptance of Terms

By accessing this website or booking services with TS Visuals, LLC, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions as well as any additional agreements or contracts related to specific projects or services.

2. Services

TS Visuals, LLC provides professional photography and videography services including, but not limited to:

Event photography and videography
Commercial and promotional video production
Brand and marketing photography
Documentary and storytelling projects
Post-production editing and media delivery

Specific service details, timelines, deliverables, and pricing will be outlined in a separate project agreement, proposal, or contract provided prior to the start of work.

3. Intellectual Property Rights

All photographs, video footage, edited videos, graphics, and other media created by TS Visuals, LLC remain the intellectual property and copyrighted work of the Company unless otherwise specified in writing.

This includes:

Raw footage
Edited footage
Photographs
Project files
Graphics and visual assets created during production

Clients are granted limited usage rights according to the licensing terms outlined in their project agreement.

Ownership of intellectual property does not transfer to the client unless a written buyout or copyright transfer agreement is executed.

4. Usage Rights and Licensing

Upon full payment of services, clients are granted a non-exclusive, non-transferable license to use the final delivered media for the purposes agreed upon in the service agreement.

Permitted uses may include:

Personal use
Social media posting
Website and marketing materials
Promotional distribution

Unless otherwise agreed in writing, clients may not:

Resell the media
Transfer usage rights to third parties
Alter the media in a way that misrepresents the work
Claim authorship of the media

Commercial or advertising usage beyond the original agreement may require additional licensing fees.

5. Portfolio and Promotional Use

TS Visuals, LLC retains the right to use any photographs or video footage created during a project for:

Portfolio display
Website galleries
Social media promotion
Marketing materials
Professional competitions or publications

If a client requires confidentiality or restricted usage, this must be requested and agreed upon in writing prior to the project.

6. Client Responsibilities

Clients agree to:

Provide accurate project details and expectations
Obtain necessary permissions or permits for filming locations
Secure appearance releases from individuals appearing on camera when required
Ensure that filming conditions are safe and suitable for production

Failure to obtain necessary permissions may limit the ability to capture certain content.

7. Payments and Deposits

Projects may require a deposit or retainer fee to secure booking dates. Unless otherwise stated:

Deposits are non-refundable
Remaining balances must be paid according to the payment schedule outlined in the service agreement
Final media delivery may be withheld until payment is received in full

Late payments may be subject to additional fees.

8. Revisions and Editing

Delivered media includes the number of revisions specified in the project agreement.

Additional revisions or editing requests beyond the agreed scope may incur additional fees.

Creative style and editorial judgment remain at the discretion of TS Visuals, LLC, consistent with the portfolio and agreed project direction.

9. Raw Footage and Unedited Images

Unless explicitly stated in a written agreement, raw footage and unedited images are not included in final deliverables and remain the property of the Company.

Requests for raw footage or additional assets may be granted at the Company’s discretion and may require an additional licensing fee.

10. Limitation of Liability

While every effort is made to produce high-quality media, TS Visuals, LLC shall not be held liable for circumstances beyond reasonable control, including but not limited to:

Equipment failure
Weather conditions
Venue restrictions
Power outages
Acts of God or emergency situations

In the unlikely event that media is lost, damaged, or not captured due to technical failure, liability will be limited to the total amount paid for the services rendered.

11. Cancellation and Rescheduling

Cancellation and rescheduling policies will be outlined in the individual service agreement. In general:

Deposits are non-refundable
Rescheduling may be accommodated depending on availability
Late cancellations may result in additional fees

12. Website Content

All images, videos, graphics, and text displayed on this website are the intellectual property of TS Visuals, LLC and may not be copied, reproduced, or distributed without written permission.

Unauthorized use of media from this website is strictly prohibited.

13. Third-Party Usage

Third parties, including vendors, sponsors, or partners, may not use or reproduce media created by TS Visuals, LLC without explicit written permission and proper licensing.

14. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Updated versions will be posted on this page with the revised effective date.

15. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida.
